Core service consents (mandatory)

Account creation & access (required)

I consent to librarywala processing my personal data to create, maintain, and manage my librarywala account. This includes login access, membership status, and service eligibility.

Book issuance & tracking (required)

I consent to the processing of my personal data for issuing, tracking, and managing physical and digital books. This includes borrowing history and return status.

Delivery & pick-up consents

Office/Home delivery of books (required if delivery enabled)

I consent to sharing my name, number and address with authorized delivery partners for book delivery. Used only for order fulfilment and not shared for any other purpose.

Book pickup / returns (required if pickup enabled)

I consent to processing my personal data for scheduling and managing book pickups and returns.
This may include coordination with delivery staff.

  1. Data Retention

Data Retention & Corporate-to-Retail Transition

7.1 Data Retention & Backups

The Company retains Personal Data only for as long as necessary to fulfil the purposes for which it was collected or as required under applicable law.

Upon closure, termination, or deactivation of a user account, all Personal Data associated with such account, including name, email address, mobile number, delivery address, login credentials, and corporate identifiers, is permanently deleted or anonymised within 30 days.

The Company does not retain Personal Data in system backups after account deletion. Backup systems are designed to exclude user-identifiable Personal Data, and no retrievable personal information remains once deletion has been completed.

Only anonymised and non-personal transactional records relating to book circulation (such as issue and return history linked to an internal membership number) may be retained for audit, accounting, and operational integrity, without any ability to identify the individual.

7.2 Corporate Account Deactivation on Employment Exit

When an employee leaves a corporate client organisation:

  1. a) the corporate account is immediately deactivated;
  2. b) all Personal Data associated with that corporate account is permanently deleted; and
  3. c) the user is removed from all employer reports, dashboards, and usage analytics. (upon Request)

The employer shall have no visibility, reporting access, or tracking of the individual after such exit.

7.3 No Automatic Conversion to Individual Account

Librarywala does not convert or migrate a corporate account into a personal or retail account.

If a former employee wishes to continue using Librarywala services, they must:

  • register again as a retail customer using a personal email address, and
  • create a new and independent account.

The new retail account has no technical or data linkage to the previous corporate account.


7.4 Employer-Provided Identifiers

All identifiers received from the employer, including employee ID, corporate email address, or SSO credentials, are permanently deleted upon account deactivation.

These identifiers are not retained, archived, or stored in any reporting, backup, or internal system.


7.5 Consent for Continued Use

Since corporate accounts are fully deleted upon exit, any new retail registration is treated as a fresh and independent user account governed by the retail terms and privacy policy.

Processing of Personal Data under the new account occurs only after the user provides fresh consent at the time of registration.

  • Request correction or deletion of inaccurate data

  1. Limitation of Liability

Nothing in this Agreement shall limit or exclude any rights of the Data Principal or any obligations of the Company that arise under the Digital Personal Data Protection Act, 2023, or any other applicable law in India.

The Company shall implement reasonable security safeguards, technical measures, and organisational controls as required under applicable law to protect Personal Data against unauthorised access, disclosure, alteration, or loss.

To the extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to the use of the Platform or Services, provided that this limitation shall not apply to:

  1. a) breach of statutory obligations under the Digital Personal Data Protection Act, 2023;
  2. b) failure to implement reasonable security safeguards;
  3. c) unauthorised or unlawful processing of Personal Data; or
  4. d) any wilful misconduct, gross negligence, or fraud.

Nothing in these Terms shall restrict the right of any Data Principal to seek compensation, file complaints, or exercise remedies available under the Digital Personal Data Protection Act, 2023 or any other applicable law.

The aggregate liability of the company for data protection–related claims shall not exceed the fees paid under this Agreement in the preceding twelve (12) months, except where prohibited by law.

  1. Policy Updates

We may update this Privacy Policy to reflect changes in regulations or service offerings. Significant updates will be notified via email or displayed prominently on our site.

  1. Grievance Redressal

In accordance with the Digital Personal Data Protection Act, 2023, the Company has appointed a Grievance Redressal Officer to address any concerns, complaints, or requests relating to the processing of Personal Data.

A Data Principal may submit any grievance, request, or complaint regarding the processing of Personal Data, including requests for access, correction, erasure, or withdrawal of consent, by emailing the above contact.

The Company shall acknowledge all grievances within 48 hours and shall endeavour to resolve the grievance within 7 (seven) working days from the date of receipt.

If the Data Principal is not satisfied with the response or if no response is received within the prescribed time, they may escalate the matter to the Data Protection Board of India in accordance with the Digital Personal Data Protection Act, 2023.

 

  1. Personal Data Breach Notification

In the event of any Personal Data Breach that is likely to affect the rights of Data Principals, the Company shall, in accordance with the Digital Personal Data Protection Act, 2023, take all reasonable steps to mitigate, contain, and remediate the breach.

The Company shall notify:

a) the affected Data Principals; and
b) the Data Protection Board of India

of such breach in a timely manner, along with information relating to the nature of the breach, the data impacted, the likely consequences, and the remedial measures being taken.

Such notification shall be made as soon as reasonably practicable and in any case within 72 hours of the Company becoming aware of the breach, unless a shorter period is prescribed by law.

Where feasible, affected users shall be informed via email/ SMS/ in-app notification, or any other reasonable means of communication.

The Company shall maintain records of all Personal Data Breaches and the remedial actions taken in accordance with applicable law.
